Privacy Policy:

1: Who are we?

We’re Jami Gold and other administrator-level associates of this site: https://jamigold.com. Jami is an author of fiction books, as well as of articles and tools she shares with writers. In addition, she offers OnDemand workshops and freelance developmental editing and story analysis services for purchase.

2: How do we collect information from you?

Most of our site’s features don’t require you to share PII, allowing you to visit our site without telling us who you are. However, some features won’t work properly if you choose to withhold your PII.

The features that require you to share PII include:

  • leaving a comment or filling out a form
  • subscribing to a newsletter
  • ordering a product or service
  • registering for our ARC (Advanced Reader Copy) Team or Backstage Pass program
  • requesting a review copy of a book

3: What type of information is collected from you?

The personal information we collect might include your name, address, email address, IP address, and information regarding your request (such as your newsletter subscription or product purchased).

In addition, we use Google Analytics, which attempts to collect less personal information, such as browser type (Firefox, Chrome, etc.), browser version, and pages viewed. We use affiliate links for Amazon, so if you click on Amazon links from our site, some non-personal information about your purchases is also collected by our Amazon affiliate account.

If you purchase a product from us, your card information is not accessed or held by us, as it is collected by our third party payment processors (i.e., PayPal), who specialize in the secure online capture and processing of credit/debit card transactions.

4: How is your information used?

We may use your information to:

  • check comments for spam or moderation status
  • display your comments on a site page or post
  • send you communications you’ve requested
  • process orders you’ve submitted
  • deal with requests for special consideration (contest giveaways, ARC fulfillment, review copies, editing feedback, etc.)
  • personalize your experience and deliver the information in which you’ve expressed an interest
  • follow up after requested communications to provide extra information or to ask for assistance
  • improve the functionality and/or engagement of the site (track shares on posts, open rates of newsletters, etc.)
  • maintain internal records

For example, when visitors leave comments on the site, we use their IP address and browser information to help detect spam, or we use their email address and other information to determine if their comments should be moderated before display. Also an anonymized string created from your email address (also called a hash) may be provided to the Gravatar service so that after approval of your comment, an avatar profile picture of WordPress/Gravatar account holders is visible with your comment.

We don’t use your information for purposes other than what you intend. For example, leaving a comment will not automatically subscribe you to our newsletters or marketing information, etc.

For the best experience of our visitors, we generally don’t delete information unless requested (see sections #6 and 7 below). For example, many of our products come with a lifetime-access guarantee that requires us to keep purchasers on record, information included with comments remains unless the comment itself is deleted, etc.

We don’t currently track our visitors across other websites, use Google AdSense/AdWords, or allow advertising on our site, so your information is not currently used by us for targeted ads. However, we do use Google Analytics, which might collect information used by Google.

Other third parties beyond our control might collect information through tracking and cookies as well. It’s possible to discourage tracking and/or disallow use of cookies through your browser (see section #9 below).

We may pass your information to our third party service providers for the purposes of completing tasks and providing requested services to you on our behalf (for example, to process orders or send ARC invitations). However, when we use third party service providers, we disclose only the personal information that is necessary to deliver the service. We won’t release your information to any other third parties unless we are required to do so by law.

When you use our secure online store, your payment is processed by a third party payment processor (i.e., PayPal). If you have any questions regarding those secure transactions, please refer to their policies.

You have a choice about whether you wish to share information with us or to receive information from us. If you decide not to share some PII with us, we may not be able to provide you some of the features and functionality of the site.

However, we will not contact you for marketing purposes unless you’ve given your prior consent. We use double-opt-in for our newsletter subscribers, and we encourage those who change their mind about their interest in our messages to unsubscribe by offering explicit invitations/reminders and instructions.

You can change your subscription preferences for either informative and/or marketing purposes at any time by clicking the links at the bottom of every message to subscribers or by requesting through this form to have your information removed from our records. however, the “right to be erased” does not include any data we are obligated to keep for administrative, legal, or security purposes.

To access, change, or delete your information gathered from other processes (such as a product order or the Backstage Pass program), please contact us at our Contact Form.

For some requests—such as changing data on your comments across our site—a fee may be charged, as we’d need to contract with our hosting company to complete your request. At the time of your request, we can investigate and respond with fee information.

8: What security precautions are in place?

We contract with a server hosting company with an aggressive policy toward computer hackers and other server/networking risks. They take security just as seriously as we do, but no online data can be guaranteed 100% secure.

Our entire site uses SSL/https encryption. While we can’t control how your computer transmits information to us, once we receive your information, we make our best effort to ensure its security on our systems.

9: What about the use of “cookies”?

Like many other websites, we use cookies—small pieces of information sent to your computer to allow our website to recognize you when you visit. They do not identify you as an individual, but help us improve our website and deliver a more personalized experience. Most cookies automatically expire, after a year or sooner.

For a few examples, while on our site, cookies may be used to:

  • identify any new comments on a post since the last time you visited that page
  • add your avatar to your comments (by matching your email address to your WordPress/Gravatar account)
  • pre-fill in your information in a comment form if you’ve left a comment before
  • keep products in your cart while you continue browsing our site

Use of this site without blocking software or settings means you agree to allow cookies to be placed on your computer. We don’t have access to your computer through our use of cookies, and we don’t have access to cookie data stored on your computer beyond what you choose to share with Google Analytics on our behalf.

It’s possible to switch off cookies by setting your browser preferences. For more information on how to switch off cookies, search for information on cookies and the name of your browser in a general web search (such as with Google) or check your browser’s Help section. Turning cookies off may result in a loss of some features when using our website.

If you don’t want your data collected with Google Analytics, you can install a browser add-on for Chrome. If you use a different browser, check with your browser manufacturer to determine if an add-on will work with your browser version or if settings can be changed.

10: What about links to other websites?

Our website contains thousands of links to sites run by other organizations. Also, articles on this site may include embedded content (e.g. videos, tweets, etc.). Embedded content from other websites behaves is if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

This Policy applies only to our website, so we encourage you to read the privacy statements on the other websites you visit. We cannot be responsible for the privacy policies and practices of other sites even if you access them using links from our website. Nonetheless, we want to protect the integrity of our site and the safety of our visitors, so we welcome any feedback about links to questionable sites.

In addition, if you visited our website through a link from a third party site, we cannot be responsible for the privacy policies and practices of the owners and operators of that third party site and recommend that you check the policy of that third party site.

Terms of Use:

1: Copyrights

Unless content is attributed to others (quotes, guest posts, comments, etc.), all materials on our site (including but not limited to: text, logos, book covers, products, downloads, courses, tools, descriptions, and promotional materials) other than licensed images are covered by copyright held by us and protected by intellectual property laws. That said, we appreciate our readers spreading the word about our information so others may gain knowledge as well, but references must include attribution and, if at all possible, a link to our site.

Permission to copy and use is granted for all material on our Media Kit page with attribution to Jami Gold and/or the name of the applicable book.

For our blog, fair use is considered quoting or reblogging up to three paragraphs from one blog post—only if credit and a link back to the full post is included. Anything more than three paragraphs requires written permission from us.

Under no circumstances is a reblog (copy or repost) of a full page or post permitted (even with credit and a link). Requests for offline use will be considered if a link and full credit is included, but our written permission is required prior to such use. Otherwise, any use beyond fair use is considered plagiarism and copyright infringement, and we actively search out and use tools to find violations.

If you are aware of others infringing upon Jami Gold’s intellectual property, we greatly appreciate you letting us know through the Contact form or through the agent information listed in Section 5 below. Please try to include all relevant information in your notice so we can decide how to proceed.

2: Disclaimers, Restrictions, Lack of Guarantees, and Limitation of Liability

Although we hope you’ll be happy with the advice we share in our content, services, and products, we make no guarantees of satisfaction due to the subjective nature of the industry. No information is applicable or appropriate for all, and we make no guarantees of results, saleability, or marketability from implementing our advice or information.

We reserve the right to ban visitors and/or edit or delete comments if we feel their presence is harmful, illegal, or disruptive to us or the visitor community at this site.

We occasionally run or host giveaways at our site. While the details of each contest varies, a purchase is never required. Refer to each giveaway to understand the applicable eligibility, prizes, entry deadline, entry rules, winner selection and notification, etc. for a specific contest.

Our content is accurate to the best of our ability at the time of posting, but old posts are usually not updated as circumstances change. The information may have been superseded or otherwise be out of date.

Information provided by guest posters may be found on other internet sites. Guest posters are expected to keep their full guest post exclusive to this site for 3 months, after which they are free to post as desired.

Our tools (worksheets, beat sheets, checklists, etc.) are provided “as is” and “as available” as a courtesy to our readers, and we make no guarantees of their ability to work on your computer systems. We are not responsible for helping troubleshoot or fix any problems you may encounter.

Our online products (workshops, etc.) are provided “as is” and “as available.” The information we provide is accurate to the best of our ability at the time of creation, but we make no guarantees of its continuing applicability or completeness.

Some content on the site is stored behind passwords for the exclusive use of purchasers of online products, and these passwords should not be shared with others. Sharing passwords with non-purchasers is considered theft and will be prosecuted appropriately.

We reserve the right to change the prices of our products and services at any time. We reserve the right to refuse or cancel orders at our discretion.

Our site includes links to other sites, which are provided for reference only. We are not responsible for their content, and our inclusion of links doesn’t imply endorsement. We all need to do our own due diligence to find the right advice, tools, and publishing partners for our goals.

3: Editing Services

(All editing services are contracted with Jami Gold specifically. Use of “we” or “our” in this section refers only to Jami Gold and not to any others assisting with this site.)

Our editing clients are granted full rights to incorporate editing suggestions as they see fit, including word-for-word inclusion. We release all claims and rights to the text in our text-change suggestions of an edit.

Editing services are offered “as available” and as we determine a good fit between our editing skills and your story. We may request the first few chapters to review before contracting to ensure we’re the right editor for the story.

Projected timeframes and deadlines are not always precisely accurate, as writing and editing are both artistic activities, where durations are hard to estimate. We’ll work with clients to accommodate to the best of our ability any timing adjustments needed by either party.

If accepted as a client, you’ll need a deposit of 50% (based on estimated word count) to hold an available calendar slot. Once editing is completed, a final amount will be calculated based on actual word count and any changes in editing level agreed upon by the parties. Invoices are due upon receipt, and we may withhold delivery of the editing feedback until paid in full.

After return of editing feedback, we will answer client questions about the feedback and suggestions. If the client has questions beyond the feedback itself—such as asking for a reread of a section—additional fees may be charged.

We will analyze and edit the material(s) according to the specifications listed on the site for the service purchased. Feedback requested beyond those specifications may incur additional fees.

We make no representations or guarantees our edit will find every possible issue or potential improvement in a story. Just as every reader can interpret a story differently, every editor will find different issues, but we spend considerable time on every editing project to find as many problems and offer as many suggestions as possible.

During the course of a Summarized or Full Developmental Edit, we may suggest a switch to the Book Doctor level if we discover serious issues with the story and feel a deeper analysis and discussion of the issues is necessary. The client has final say over this choice, but we reserve the right to stop the edit at that point and provide all analysis and notes compiled so far in exchange for any remaining payment of the word count completed.

A story analysis can identify and suggest fixes for many issues, but it’s not a replacement for a developmental edit. Similarly, developmental edits are an important step in the editing process, but they are not intended to point out grammatical, sentence structure, or wording problems. Line and/or copy edits are still recommended.

Although we hope you’ll be happy with our services, we make no guarantees of satisfaction due to the subjective nature of the industry. We also make no guarantees of results, saleability, or marketability from implementing our advice or suggestions.

4: Refunds and Indemnification

Regardless of satisfaction or results, services and online products can’t be “returned,” so refunds will be issued only in cases where the service or product can’t be delivered.

Use of this site means you agree to indemnify and hold us—and Jami Gold specifically—harmless from and against any and all claims, damages, costs, and expenses arising from or related to use of our site, content, tools, services, or products.

Upon obtaining such knowledge we will act expeditiously to remove, or disable access to, the material. Please be aware that there are substantial penalties for false claims.
